General Policy

Representations and Warranties

The Seller represents and warrants to the Buyer that as of the date of this contract:

  • The Seller is the lawful owner of the Cat;
  • The Cat has been examined by a licensed Veterinarian and is current on all vaccinations and other preventative care.
  • The Cat is free from any known disease or condition that could adversely affect the Cat's health or life;
  • The Cat has been properly socialized and has no known aggressive tendencies or behavioral issues

    • Health Guarantee

    The Seller guarantees that the Cat is in good health and free from any diseases at the time of delivery. The Buyer has the right to have the Cat examined by a licensed Vet within 2 days of delivery. If the Vet finds that the Cat is not in good health, the Buyer may return the Cat to the Seller for a full refund. The Buyer is obligated to pay shipping, though the Seller may cover the cost at the Seller's discretion. The Buyer must provide documentation from the Vet to support any claim of poor health.

    • "Vet" or "Veterinarian" refers to a licensed veterinarian in Canada.

    Care and Treatment

    The Buyer agrees to care for the Cat in a responsible and humane manner. The Buyer agrees to provide the Cat with adequate food, water, shelter, and medical care throughout the Cat's life. The Buyer should provide annual Veterinary check-ups and vaccinations to the Cat. The Buyer should also provide the Cat with appropriate toys, scratching posts, and other necessary items for the Cat's health and well-being.

    Indemnification

    The Buyer agrees to indemnify and hold harmless the Seller, its agents, employees, and affiliates from any and all claims, damages, or expenses arising from the Buyer's ownership or care of the Cat.

    Ownership

    The Seller retains ownership of the Cat until the Buyer has paid the full purchase price. The Buyer agrees to pay the full purchase price within 2 days of delivery. If the Buyer fails to pay the full purchase price within 2 days of delivery, the Seller may reclaim the Cat and retain any payments made by the Buyer as liquidated damages.

    Assignment

    This contract shall not be assignable by either party without the prior written consent of the other party, except that the Buyer may assign this contract to any person who takes ownership of the cat in accordance with the terms of this contract.

    Confidentiality

    The Parties acknowledge and agree that all information disclosed in connection with this contract shall be treated as confidential and shall not be disclosed to any third party without the prior written consent of the other party, except as required by law.
